If you are under 18 years of age - STOP here - do not fill out this application. We have only limited opportunities for youth volunteers under the direct supervision of a parent volunteer.

1.  PARTIES TO AGREEMENT

This Agreement is between Hero Dogs, Inc. (here after referred to as “Hero Dogs”) and the above named volunteer residing at the address provided above (here after referred to as “Volunteer”).

2.  COMMENCEMENT

This Agreement is effective as of the date signed below. The Volunteer accepts this Agreement is retrospective.

3.  CONFIDENTIALITY

The Volunteer acknowledges that, throughout the term of this Agreement or their activities with Hero Dogs, they may, by reason of performing such duties, have access to certain confidential information relating to the operations and activities Hero Dogs to include but not limited to phone lists, mailing lists, databases, financial information, lists of donors and funding sources, and other internal information.

Consequently, the Volunteer agrees, throughout the term of this Agreement and at all times following the termination thereof for any reason whatsoever, to neither disclose, use, communicate, reveal, nor make available to any person whomsoever in any manner whatsoever, any confidential information without the express approval of the Executive Director.

4.  REMUNERATION/BENEFITS

The Volunteer agrees to work without financial reward. Any expenses incurred in connection with their activities with Hero Dogs must be pre-approved by the Executive Director in order to be reimbursed. Most expenses should be paid directly by the organization via Hero Dogs check or credit card rather than by the Volunteer. All expense claims should be submitted to the Office Manager within 90 days. Hero Dogs is under no obligation to reimburse expenses submitted after the deadline.

5.  CODE OF CONDUCT

The Volunteer agrees to adhere to, accept, and follow Hero Dogs policies and procedures as set out in the Hero Dogs Volunteer Policies and Procedures Manual. The primary means of communicating with volunteers is via e-mail, and the Volunteer’s e-mail address will be subscribed to Hero Dogs' electronic mailing lists. If the Volunteer chooses to unsubscribe from the e-mail lists, the Volunteer understands that it is their responsibility to keep informed of changes in Hero Dogs policies and procedures.

6.  HERO DOGS PROPERTY

Upon suspension of volunteer activities, or upon Hero Dogs' request at any time, the Volunteer will immediately return all Hero Dogs supplies, equipment, records, monies, and other items in good clean condition. Upon suspension of volunteer activities or upon Hero Dog’s request, the Volunteer agrees to delete any electronic records pertaining to Hero Dogs the Volunteer may have on their personal computer or computers.

7.  ASSUMPTION OF RISKS

The Volunteer understands that volunteering with Hero Dogs may bring them into contact with animals and that there is an inherent danger in working with animals. The Volunteer assumes the risks of being bitten, scratched, injured, and/or frightened by animals in connection with their volunteer work with Hero Dogs. The Volunteer also assumes the risk that their personal property may be damaged or destroyed by animals in connection with their volunteer work with Hero Dogs.

8.  SEVERABILITY

Should any section, phrase, paragraph or part of this Agreement be deemed unenforceable for any reason by any court of competent jurisdiction, such decision shall neither amend the remainder of this Agreement nor render it void.

9. LEGAL ACTIONS

In consideration for permitting the Volunteer to participate in these activities, on behalf of the Volunteer, as well as their executors, administrators, heirs, next of kin, successors, and assigns, the Volunteer hereby waives, releases and forever discharges Hero Dogs, its officers, directors, employees, agents, volunteers, and all persons acting under their permission or authority or those for whom they are acting, from any and all claims, causes of action, or liability including, but not limited to any injuries, damages, liabilities, losses, judgments, costs, and/or expenses which the Volunteer might suffer in connection their affiliation with Hero Dogs. Furthermore, the Volunteer hereby indemnifies, holds harmless, and promises not to sue the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of  the Volunteer’s affiliation with Hero Dogs. The Volunteer further agrees to indemnify and hold harmless the entities or persons mentioned in this paragraph from any and all claims, causes of action, or liability including, but not limited to any injuries, damages, liabilities, losses, judgments, costs, and/or expenses which any of the Volunteer’s relatives or guests might suffer in connection the Volunteer’s affiliation with Hero Dogs, Inc.

10. SUCCESSORS

This Agreement shall inure to Hero Dogs benefit, as well as to the benefit of possible successors. Hero Dogs reserves the right to change its name at any time.

By signing my name below, I attest that I am at least 18 years of age, and I have read, understood, and agree to the above conditions of the Hero Dogs Volunteer Agreement. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

In connection with my activities with Hero Dogs, Inc. (hereafter Hero Dogs), as a volunteer, employee, applicant, trainee, or any other relationship, I, the undersigned, understand that I may learn or receive confidential medical and/or personal information, materials, and/or data, directly or indirectly, from Hero Dogs relating to persons seeking to receive a service dog to assist them with their daily living activities (“Applicants”). All information, oral and/or written, pertaining to Applicants is presumed to be confidential regardless of whether such information was designated as confidential at the time of its disclosure. All copies of Applicant documents and/or records submitted to Hero Dogs, whether in physical or electronic form, are and will remain the property of Hero Dogs.

I agree to the following:

During and after my activities and/or duties with Hero Dogs, I agree to keep confidential and

1. not use or disclose for any purpose other than in connection with my role at Hero Dogs, and
2. not disclose to any person other than those authorized by Hero Dogs and/or the Applicant

any confidential medical and/or personal information that I am provided or may learn.

I also agree to promptly return all confidential medical and/or personal information in my possession, custody, or control to Hero Dogs upon termination of my activities or upon official request by a duly authorized Hero Dogs representative and/or the Applicant. Any confidential medical and/or personal information in my possession that is in electronic form must be deleted or destroyed within 48 hours of cessation of activities with Hero Dogs.

BY SIGNING MY NAME BELOW, I ATTEST THAT I AM AT LEAST 18 YEARS OF AGE, AND I HAVE READ, UNDERSTOOD, AND AGREE TO ABIDE BY THE TERMS OF THE HERO DOGS CONFIDENTIALITY AGREEMENT.

I hereby grant Hero Dogs, Inc., permission to use my likeness in a photograph or other digital reproduction in any and all of its publications, including electronic, without payment or any other consideration.

In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph.

In addition, if I provide a photograph of which I am the legal copyright owner to Hero Dogs, Inc. (via email, upload to any Hero Dogs, Inc. website or photo album, physical copy, or any other method), I am implicitly and irrevocably granting Hero Dogs, Inc. permission to use, copy, edit, alter, exhibit, publish or distribute this photo, in any format, for purposes of publicizing its programs or for any other lawful purpose. I understand and agree that these materials will become the property of Hero Dogs, Inc. and will not be returned.

I hereby hold harmless and release and forever discharge Hero Dogs, Inc., its officers, directors, employees, agents, and volunteers, and all persons acting under their permission or authority or those for whom they are acting, from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I HAVE READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE.
